What if you were denied court-ordered holiday timesharing?

During the holidays, some parents unfortunately find themselves in the middle of nasty child custody issues which derail even court ordered timesharing. Here’s what you may want to consider if you are one of these parents. 

Court ordered timesharing can be enforced via a motion for contempt and the parent who withheld timesharing may be called to court to explain why he or she should not be held in contempt of court for violating a visitation order. Unfortunately, since missed timesharing is usually not considered an emergency matter and many courts are closed during the holidays, it may be well after the missed timesharing that a hearing is held.

Some of the punishments for a parent who is found to have wrongfully withheld timesharing include:

  • Fines
  • Community service  
  • Makeup timesharing for the other parent
